Tim represents public and private sector employers in federal and state employment litigation and provides day-to-day counseling to his clients on a wide variety of employment matters. Tim litigates cases under Title VII, ADA, ADEA, FMLA, FLSA, Georgia RICO, the Georgia Whistleblower Act, and constitutional claims brought under 42 U.S.C. § 1983. In addition, Tim's experience includes conducting workplace investigations, designing employment policies and procedures, and handling administrative law matters before the Equal Employment Opportunity Commission (EEOC) and other government agencies. As a member of the firm’s Public Sector Group, Tim focuses on the representation of cities, counties, school districts, and other government entities. Prior to joining Elarbee Thompson, Tim served as an in-house employment counsel and litigator for the City of Atlanta.
Tim defends state and local government employers in connection with lawsuits, EEOC charges, unemployment claims, grievances and appeals filed by employees and advises employers on all phases of employment law, including training.
Obtained full grant of summary judgment for government employer before the Northern District of Georgia as to the plaintiff’s claims of race, sex, and retaliation under Title VII and discrimination and retaliation under the ADA.
Achieved dismissal as to plaintiff’s claims of sexual harassment and hostile work environment under Title VII and § 1983 Equal Protection, negligent supervision and retention, and intentional infliction of emotional distress on behalf of government employer and government supervisor.
