Daniel’s practice focuses on counseling clients regarding workplace and business-related legal issues, as well as litigating labor, employment, and complex business disputes.

 

Daniel has experience litigating in a wide range of contexts and subject areas, including labor and employment matters, business torts, breach of contract claims, shareholder disputes, franchising disputes, and RICO actions. 

 

Specific to labor and employment law, Daniel defends corporate clients against discrimination claims under Title VII and the ADA, wage and hour issues, unfair competition claims, labor grievances, and other employee-initiated disputes.

 

In addition to his litigation practice, Daniel frequently guides clients through day-to-day labor and employment matters, conducting workplace investigations, drafting commercial agreements, and providing counsel on unique employment issues.

 

Born and raised in Winston-Salem, North Carolina, Daniel graduated from Wake Forest University with degrees in Political Science and History before moving to Atlanta, where he attended law school at Georgia State.  Following his graduation from law school, Daniel worked for a boutique litigation firm until joining Elarbee Thompson.  Now an Associate with Elarbee Thompson, Daniel applies his practice experience in a variety of industry contexts to serve as a diligent advocate for his clients.

 

Daniel lives in the Buckhead neighborhood of Atlanta with his wife, Kinzer, their son, Tripp, and their black lab.  Outside the office, you will find Daniel spending time with his family and friends, watching Wake Forest sports, and playing far too much golf.

Representative Matters

Daniel has achieved favorable outcomes in a wide range of employment-related and commercial litigation.  He regularly defends employers in harassment and discrimination lawsuits brought under federal law, including the Americans with Disabilities Act, Age Discrimination in Employment Act, and Title VII of the Civil Rights Act of 1964. He also routinely advises employers nationwide, including companies in the hospitality, media/communications, commercial real estate, manufacturing, and service-related industries, on a variety of employment and traditional labor matters.

  • Successfully defended a national restaurant chain in an action alleging harassment and discrimination.
  • Achieved dismissal of employment-related administrative charges against an international manufacturing company.
  • Represented a media broadcasting company in negotiation of a collective bargaining agreement.
  • Worked with a large restaurant chain to defend and resolve a Title III ADA claim.
  • Negotiated executive employment contracts on behalf of employers and executive candidates.
  • Provides ongoing counseling and assistance to clients, including those in the commercial real estate, manufacturing, and service industries, to ensure compliance with federal and state labor and employment laws.
